29 CFR 1910.157(c)(1):The employer shall provide portable fire extinguishers and shall mount, locate and identify them so that they are readily accessible to employees without subjecting the employees to possible injury. On or about February 9, 2023, and times thereto, portable fire extinguishers were not readily accessible without subjecting employees to injuries if they tried to move items to access the fire extinguishers, as described in the following instances: a) EcoLab Station 4(decal)- There is a clutter of a shelf framing, shelf pieces and a pallet jack that is obstructing a path to the fire extinguisher. b) Exit door at the rear of the store by the "Warehouse DAMAGES" area- A meatal shelf was obstructing the path of the fire extinguisher.

29 CFR 1910.157(e)(3): The employer shall assure that portable fire extinguishers are subjected to an annual maintenance check. Stored pressure extinguishers do not require an internal examination. The employer shall record the annual maintenance date and retain this record for one year after the last entry or the life of the shell, whichever is less. The record shall be available to the Assistant Secretary upon request. On or about February 9, 2023, and at times thereto, the employer failed to perform an annual fire extinguisher maintenance check, that was in the rear receiving area next to a stack of shelf panel and frame, exposing employees to fire hazards. The fire extinguisher was last inspected August 2015.
