29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  a) Residential Construction at 185 Pine Needle Drive Dawsonville, GA 30534. Roof: On or about 01/27/2023, and at times prior, the employer exposed employees to fall hazards at approximately 13-feet, 4 inches to the lower ground level, in that a fall protection system was not provided to employees engaged in framing activities.  Samuel Ledesma Sanchez was previously cited for a violation of this occupation safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA Inspection Number 1519777, citation number 1, item number 2 and was affirmed as a final order date on 05/26/2021, with respect to a workplace located at (Lot #53) 2216 Swansea Way, SMYRNA, GA 30080.

29 CFR  1926.1052(c)(1)(ii):One stairrail system along each unprotected side or edge.  a) Residential construction located at 185 Pine Needle Drive Dawsonville, GA 30534. Stairway: On or about 01/ 27/2023, and at times prior, the employer exposed employees to fall hazards of approximately 4-feet to the lower concrete surface, in that a stair rail was not installed along the open sides of the stairway used by employees to access the second level.
