OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard. On or about February 22, 2023, and at times prior thereto, four employees were installing sections of a new storm drainage system and working near a John Deere Excavator 300G LC being used to move reinforced concrete pipe (RCP), exposing the employees to the hazard of being struck by materials and equipment.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). On or about February 22, 2023, three employees were installing underground utilities inside of an excavation over seven feet deep without a protective system in place, exposing employees to a cave-in hazard. The Kieschnick General Contractors was previously cited for a violation of this occupational safety and health standard, or it is equivalent standard 1926.652(a)(1), which was contained in OSHA inspection number 1586148, citation number 1, item number 1 and was affirmed as a final order on May 3, 2022, with respect to a workplace located at Bullinger Creek Drive, Bryan, Texas 77808.
