29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite-specific procedures was not established and implemented for required respirator use: At the commercial worksite located at 1600 West 8th Street in Kansas City, Missouri 64101: Employees were exposed to toxic or hazardous substances in the form of dust and paint fumes. This was most recently demonstrated on or about February 27, 2023, and at times prior to when employees were wearing a half-face tight-fitting elastomeric respirator as they cleaned the dust collection system and spray paint as part of their daily duties. The employer failed to implement a written respiratory protection program to cover such operations prior to employees' use of a respirator.

29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program that included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): At the commercial worksite located at 1600 West 8th Street in Kansas City, Missouri 64101: Employees were exposed to toxic or hazardous substances in the form of paints, solvents, and epoxy applications, as well as skin conditions including but not limited to dermatitis or undetected medical conditions. This was most recently demonstrated on or about February 27, 2023, and at times prior to when employees were not informed of the hazards associated with working with these chemicals. Hazards from these products include fire, respiratory, and skin contact illnesses ; the employer had not developed or implemented a written hazard communication program.
