29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). On or about February 27, 2023, at an excavation site located at 2936 N. Shields Blvd, Moore, OK, employees worked in an excavation more than 5 feet deep without stepping, slopping, or other protective systems, exposing employees to struck-by hazards.

29 CFR 1926.1053(b)(1): A portable ladder used for access to an upper landing surface did not have the ladder side rails extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grab rail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. On or about February 27, 2023, at an excavation site located at 2936 N. Shields Blvd, Moore, OK, the ladder the employees used to access/egress the excavation did not extend at least 3 feet beyond upper landing of the excavation exposing the employee to the hazard of falls.
