29 CFR 1926.51(f)(1): The employer shall provide adequate washing facilities for employees engaged in the application of paints, coating, herbicides, or insecticides, or in other operations where contaminants may be harmful to the employees. Such facilities shall be in near proximity to the worksite and shall be so equipped as to enable employees to remove such substances.  On or about March 1,2023, employees engaged in residential activities were not provided with adequate washing facilities while working with Western 1-Kote Concentrate. This condition exposed the employees to severe effects including thickening, cracking or fissuring of the skin. Prolonged contact can cause severe skin damage in the form of caustic chemical burns and blindness.

29 CFR  1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.  On or about March 1, 2023, employees performing residential construction activities were not utilizing head protection. This condition exposed employees to struck-by hazards.

On or about March 1,2023, the employer did not ensure that employees were wearing eye protection while applying and mixing stucco materials.  This condition exposed employees to a chemical burns and blindness.

29 CFR  1926.451(c)(2): Supported scaffold poles, legs, posts, frames, and uprights shall bear on base plates and mud sills or other adequate firm foundation.  On or about March 1, 2023, employees engaged in construction activities were observed working on a scaffold platform that was not supported on base plates and mud sills that were adequate and firm to use as a foundation. This condition exposed employees to fall hazards.

29 CFR 1926.1153(i)(1): Communication of respirable crystalline silica hazards to employees-Hazard communication. The employer shall include respirable crystalline silica in the program established to comply with the hazard communication standard (HCS) (29 CFR 1910.1200). The employer shall ensure that each employee has access to labels on containers of crystalline silica and safety data sheets and is trained in accordance with the provisions of HCS and paragraph (i)(2) of this section. The employer shall ensure that at least the following hazards are addressed: Cancer, lung effects, immune system effects, and kidney effects.  On or about March 1,2023, the employer did not ensure the safety data sheet were readily accessible during each work shift. This condition exposed employees to respiratory stress, ingestions and irritation of skin and eyes.
