OSH ACT of 1970 Section (5)(a)(1) The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards from the potential displacement A-Frame style ladders while performing work on ventilation equipment while on a low slope roof: a.) Wabtec US Rail, Inc., Roof of Building 5, on or about 2/14/23, and times prior thereto: Employees engaged in maintenance activities related to an exhaust fan used a Werner 6? Type 1A A frame ladder as a straight ladder. The use of an ?A? frame type ladder as a straight ladder on a low slope roof created a fall hazard to which employees were exposed during the exhaust fan maintenance activities. b.) Wabtec US Rail, Inc., Roof of Building 5, on or about 2/14/23, and times prior thereto: Employees engaged in maintenance activities used a Werner 6' Type 1A A frame Ladder. The ladder was used on a sloped surface and was not secured by devices or alternative measures to prevent accidental displacement. Maintenance activities include but are not limited to, repairing the exhaust stack. ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement.

29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): a.) Wabtec US Rail, Inc. Roof of Building 5, on or about 2/14/23, and times prior thereto, , Employees engaged in maintenance activities on the roof were not utilizing fall protection systems to protect against the 14.5-15-foot fall hazard . Employees were working within 0-15 feet from the edge of the roof. Maintenance activities include but are not limited to, repairing the exhaust stack. b.) Wabtec US Rail, Inc. Roof of Building 5, on or about 2/14/23, and times prior thereto, Employees walking on the roof to access and egress a fixed ladder were not utilizing fall protection systems. The roof is upwards of 15 feet from the ground. Employees were walking 0-10 feet from the edge of the roof. c.) Wabtec US Rail, Inc. Roof of Building 5, on or about 2/14/23, and times prior thereto, Employees engaged in maintenance activities on the roof were not utilizing fall protection systems to protect against the 15-foot fall hazard. Employees were working within 2-3 feet from the edge of the roof. Maintenance activities include but are not limited to, using a rope system to bring material to the exhaust stack from a lower level. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation. This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement. IN ADDITION, abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic, or video evidence or abatement or other written records.
