29 CFR  1926.1053(b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet above the upper landing surface to which the ladder was used to gain access:  (a) On or about March 6, 2023, in the vicinity of 6940 67th Street South Horace, North Dakota, the employees using ladders to access an upper working surface of a 12.8 foot, 5/12 pitched roof while shingling a residential building did not have the side rails extending at least three feet above the upper working surface in the vicinity of 6940 67th Street South, Horace, North Dakota.  (b) On or about March 6, 2023, in the vicinity of 6940 67th Street South Horace, North Dakota, the employees using ladders to access an upper working surface of a 9.5 foot, 5/12 pitched roof while shingling a residential building did not have the side rails extending at least three feet above the upper working surface in the vicinity of 6940 67th Street South Horace, North Dakota.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system:  (a) On or about March 6, 2023,  in the vicinity of 6940 67th Street South, Horace, North Dakota, employees were exposed to fall hazards up to 12.8 feet  on a 5/12 pitched roof while preparing to shingle a residential building.  Note:  This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1556216, Citation 1, Item 1, and was affirmed as a final order on January 14, 2022, with respect to a workplace located at 26th Street South & 66th Avenue South, in Fargo, North Dakota.  Note:  This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1360280, Citation 1, Item 1, and was affirmed as a final order on March 5, 2019, with respect to a workplace located at 54th Avenue & 38th Street in Fargo, North Dakota.  Note:  This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1330316, Citation 1, Item 1, and was affirmed as a final order on August 24, 2018, with respect to a workplace located at 7380 17th Street South in Fargo, North Dakota.
