29 CFR 1926.651(k)(2): Where there was evidence of a situation that could result in a possible cave-in or other hazardous condition, the competent person did not remove exposed employees until necessary precautions could be taken to ensure their safety. (a) On or about March 6, 2023, employees were exposed to cave-in and struck-by hazards while conducting eight (8) inch diameter sanitary pipe installation work in a trench that was not properly protected. The trench box installed at the South end of the trench was placed between approximately one (1) foot six (6) inches below grade on the North end of the trench shield box and three (3) feet three (3) inches below grade on the South end of the trench shield box. (b) On or about March 6, 2023, employees were exposed a cave-in and struck-by hazard when required to travel past an approximately four (4) foot wide by twelve (12) foot high unshielded portion of the excavation created between the two trench shield boxes to access the extension ladder used for egress from the trench. (c) On or about March 6, 2023, the two trench shield boxes being used in the trench, did not have all spreader pins installed, or properly installed in the horizontal support bars as is required by the tabulated data for full support of the structure.

29 CFR 1926.652(g)(1)(ii): Shields shall be installed in a manner to restrict lateral or other hazardous movement of the shield in the event of the application of sudden lateral loads. (a) On or about March 6, 2023, an employee was conducting eight inch diameter sanitary main installation preparation while working in improperly shored areas of an excavation greater than twelve (12) feet in depth. Areas of improper shoring included the four (4) foot wide by 12 foot in height area of trench wall located between the two trench shields, and approximately three (3) feet of unprotected trench wall above the south trench shield. This exposed an employee to a trench collapse and engulfment hazard from previously disturbed "Class C" soil. American Sewer Services, Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.652(a)(1), which was contained in OSHA inspection number 1621595, citation number 1, item number 1b and was affirmed as a final order on 02/07/2023, with respect to a workplace located at 8001 N Port Washington Rd. Fox Point, WI 53217.

(a) On or about March 6, 2023, employees working in the twelve (12) foot deep trench were exposed to struck-by hazards from gravel, dirt, rocks, tools and other work related items located directly above the trench top edge on both the East and West sides of the excavation.
