29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    location: 2nd floor on or about: 3/8/23  a) An employee was sitting on the wood framing of the second floor, while applying spray foam.  The employee was exposed to a fall of  approximately 10 feet.   NOTE: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step:  Location: 1st floor On or about: 3/8/23  a) An employee used the top step and top cap of an 8' portable A-frame ladder while engaged in insulation work.  Location: 1st floor On or about: 3/8/23  b) An employee used the top step of an 6' portable A-frame ladder while engaged in insulation work.   NOTE: Because abatement of this violation is already documented in the inspection casefile, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
