OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards while operating a forklift without a seatbelt: a) Welding Shop: On or about 9 March, 2023, the employer exposed employees to crushed-by hazards, in that employees were required to operate a Caterpillar forklift, serial # AT81F40253 without a functioning seatbelt. b) Welding Shop: On or about 9 March, 2023, the employer exposed employees to crushed-by hazards, in that employees were required to operate a Nissan forklift, Serial # LP-PH02-002623 without a functioning seatbelt. c) Welding Shop: On or about 9 March, 2023, the employer exposed employees to crushed-by hazards, in that employees were required to operate a Nissan forklift, Serial # LP-5021352-05 without a functioning seatbelt. d) Welding Shop: On or about 9 March, 2023, the employer exposed employees to crushed-by hazards, in that employees were required to operate a Yale forklift, Serial # EL87V034560 without a functioning seatbelt.
