29 CFR 1926.651(c)(2):A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: a) On or about March 15, 2023, employees were exposed to cave in hazards while working in a trench in excess of five feet deep with no means of egress in place. No ladder, ramp or any other means for entering or exiting the trench was provided.

1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person: a) On or about May 15, 2023, BT Construction Inc. as a controlling employer, did not ensure that its employees were safe from health and safety hazards by conducting effective frequent and regular safety inspections of the jobsite by a competent person, and ensuring hazards were identified and mitigated such as but not limited to, cave in hazards while working in an unprotected trench.
