29 CFR  1903.19(c)(1):Within 10 calendar days after the abatement date, the employer must certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section.  a)  The employer failed to submit certification of abatement within 10 calendar days of the abatement date for Citation 1 Item 1, and  Citation 1 Item 2.   ABATEMENT CERTIFICATION REQUIRED PER 29 CFR 1903.19(c).

29 CFR  1903.19(d)(1):The employer must submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.   a)  The employer failed to submit documentation of abatement within 10 days of the abatement date for Citation 2 Item 1.  ABATEMENT DOCUMENTATION REQUIRED PER 29 CFR 1903.19(d).

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.  a) On or about March 21, 2023, at the previously addressed inspection site, employees accessed the roof of a residential building by using a portable ladder with side rails that did not extend at least 3 feet above the roofs landing surface exposing the employees to falls.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b).  a) On or about March 21, 2023, at the previously addressed inspection site, employees framing and installing wooden trusses on the roof of a residential building at heights greater than six feet above lower levels were not protected from falls to the lower levels.  Gilberto Lagunas LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1509972, citation number 1, item number 1 and was affirmed as a final order on May 4, 2021, with respect to a workplace located at 655 Burnt Sienna Dr., Middleton, WI 53562.  Gilberto Lagunas LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1468686, citation number 1, item number 1 and was affirmed as a final order on July 9, 2020, with respect to a workplace located at Derby Downs Drive (Lot 143), Waunakee, WI 53597.
