29 CFR  1903.19(d)(1):The employer must submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.  a)  The employer failed to submit documentation of abatement within 10 days of the abatement date for Citation 1 Item1, Citations 1 Item 2, and Citations 2 Item 1.

29 CFR  1926.100(a):Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  On or about July 15, at the previously addressed job site, two employees were observed setting rafters.  The rafters were lifted overhead of the employees and lowered into place while employees not wearing a protective helmet to prevent their head from being struck by the rafters or the lifting device.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles.  On or about July 15, 2024, at the previously addressed job site, employees were observed using pneumatic nail guns without appropriate eye protection and were exposed to flying particle hazards.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   On or about July 15, 2024, four employees were observed working at heights greater than 6 feet without being  protected by guardrail systems, safety net system, or personal fall arrest system.  The employer does not protect each employee on the roof by ensuring that all employees are tied off to their lanyards or by using other fall protection systems. This violation was most recently observed at Honey Bee Ct, Windsor, WI 53598. To abate this violation, the employer must ensure that its employees performing roofing work are protected from falls, and that no employee is allowed onto a roof without adequate fall protection.  Pursuant to 29 C.F.R. 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including an explanation of how these steps protect its employees from falls.  This employer has been previously cited for this practice:  Gilberto Lagunas LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1658013, citation number 2, item number 1 and was affirmed as a final order on April 4, 2023, with respect to a workplace located at 660-662 Hillcrest Drive, Waunakee, WI 53597.  Gilberto Lagunas LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1509972, citation number 1, item number 1 and was affirmed as a final order on May 4, 2021, with respect to a workplace located at 655 Burnt Sienna Dr., Middleton, WI 53562.  Gilberto Lagunas LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1468686, citation number 1, item number 1 and was affirmed as a final order on July 9, 2020, with respect to a workplace located at Derby Downs Drive (Lot 143), Waunakee, WI 53597.
