29 CFR 1926.100(a):   Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  a)  Worksite, The Vineyards at Mt. Sinai, 49 Farm Acre Circle, Mount Sinai, NY 11766 - Employees were not wearing protective helmets and were exposed to being struck by lumber and tools while walking and working below overhead roofing work; on or about 03/21/23.  Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

Sinai, 49 Farm Acre Circle, Mount Sinai, NY 11766 - Employees were using a pneumatic nail guns to install framing on the roof of a two story residential home.  The employees were not provided with eye protection; on or about 03/21/23.   Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.501(b)(13):   Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.  a)  Worksite, The Vineyards at Mt. Sinai, 49 Farm Acre Circle, Mount Sinai, NY 11766 - Employees were installing framing on the roof of a two story residential home.  The employees were not protected from falling approximately 20ft to the ground below; on or about 03/21/23.   Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.1053(b)(1): Portable ladder used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:  a)  Worksite, The Vineyards at Mt. Sinai, 49 Farm Acre Circle, Mount Sinai, NY 11766 - Employees were accessing the roof of a two story residential home by using an extension ladder that was extended approximately 2ft above the landing; on or about 03/21/23.   Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
