Sinai, 89, 90, and 91 Farm Acre Circle, Mount Sinai, NY 11766 - Employees were framing a two-story residential home.  One employee was using a pneumatic nail gun and was not wearing eye protection; on or about 05/24/23.   Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.501(b)(13):   Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.  a) Worksite, The Vineyards at Mt. Sinai, 89, 90, and 91 Farm Acre Circle, Mount Sinai, NY 11766 -  Employees were framing the roof of a two-story residential home.  The employees were not protected from falling approximately 10 feet to the ground below;  on or about 05/24/23.   Note:  In addition to abatement certification the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR  1926.300(b)(2): Moving part(s) of equipment exposed to contact by employees or which otherwise created a hazard, were not guarded:       a) Worksite, The Vineyards at Mt. Sinai, 89, 90, and 91 Farm Acre Circle, Mount Sinai, NY 11766 - Employees were framing the roof of a two-story residential home using an air compressor without a guard exposing the employees to injuries from the rotating fly wheels, and rotating belt; on or about 05/24/23.  Note:   Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.
