29 CFR 1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function: (Construction Reference 1926.103) At a worksite located at 311 West 22nd Street Kansas City, MO 64108: Employees were exposed to health hazards in that they may be exposed to toxic or hazardous substances. This was demonstrated on or about January 5, 2023, and at times prior to when employees were exposed to crystalline silica hazards when employees were directed to use a tight-fitting respirator while dry jackhammering/chipping of concrete pillars

This was demonstrated on or about January 5, 2023, and at times prior to when employees were exposed to unguarded reinforcing steel when employees were jackhammering/chipping on concrete pillars.

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section: At a worksite located at 311 West 22nd Street Kansas City, MO 64108: Employees were exposed to health hazards in the form of crystalline silica. This was demonstrated on or about January 5, 2023, and at times prior to when employees were exposed to the respiratory risks from dust generated by jackhammering/chipping of concrete pillars. Wet methods or dust/vacuum collection systems with high-efficiency particulate air (HEPA) filters were not used. Employees were exposed to respiratory hazards from the accumulation of dust when the vacuum systems or wet methods were not utilized during the course of the project.
