29 CFR 1910.119(d)(3)(i)(A): The employer did not complete a compilation of process safety information pertaining to the material of construction of equipment in the process. On or about March 21, 2023, the employer did not complete a compilation of process safety information pertaining to the materials of construction regarding process piping throughout the engine room of Borden Dairy in Austin, TX including, but not limited to, information regarding pipe size, metal type, required pipe support, original pipe wall thickness, and corrosion rate for the following sections of piping: a) HTR-1 to EV-1 piping segment (PID BAUTX-09 rev5 to PID BAUTX-013 rev3); b) HPL to HTR-1 piping segment (PID BAUTX-07 rev4 to PID BAUTX-09, rev5; c) HTR-1 to PH-1 piping segment (PID BAUTX-09 rev5, to PID BAUTX-14, rev3). This exposed employees to inhalation, dermal burns and death.

29 CFR 1910.119(e)(1): The process hazard analysis was not appropriate to the complexity of the process and did not identify, evaluate, and control the hazards involved in the process. On or about March 21, 2023, at Borden Dairy of Austin, TX, in accordance to the schedule set forth in paragraph (e)(1) of this section, the employer did not complete a compilation of written process safety information before conducting any process hazard analysis required by the standard. This violation was most recently observed in the anhydrous ammonia engine room when the employer failed to document and maintain accurate process safety information (PSI), such as but not limited to materials of construction for the following process equipment: a) HTR-1 to EV-1 piping segment; (PID BAUTX-09 rev5 to PID BAUTX-013 rev3); b) HPL to HTR-1 piping segment; (PID BAUTX-07 rev4 to PID BAUTX-09, rev5); c) HTR-1 to PH-1 piping segment; (PID BAUTX-09 rev5, to PID BAUTX-14, rev4). This exposed employees to inhalation, dermal burns and death.

29 CFR 1910.119(d)(3)(ii): The employer did not document that equipment complies with recognized and generally accepted good engineering practices. Inhalation. On or about March 21, 2023, and at times prior thereto, the employer did not ensure that the ammonia refrigeration engine room complied with its chosen RAGAGEP, such as but not limited to ANSI/IIAR 2-2014-Standard for Safe Design of Closed-Circuit Ammonia Refrigeration Systems and ANSI/ASH RAE Standard IS-2013-Safety Standard for Refrigeration Systems. Employees work in the ammonia refrigeration engine room on a daily basis performing operational tasks such as but not limited to draining oil, performing pump or compressor inspections, monitoring operating conditions, conducting leak inspections and other maintenance activities. a) The employer did not install audio and visual alarms outside and inside of the main entrance door to the engine room. b) The employer did not install a remote control shut off for the mechanical equipment in the refrigerating machinery room. c) The employer did not install a control switch for the ventilation fan immediately outside the engine room entrance doors.

On or about March 21, 2023, and at times prior thereto, the employer did not conduct testing and inspections to maintain the ongoing integrity of the process equipment including pressure vessels and process piping. Process equipment includes but is not limited to the following: a) High Pressure Receiver (HPR-1), (BAUTX-07 rev4); b) High Temperature Recirculator (HTR-1), (BAUTX-09 rev 5); c) Evaporative Condenser (EV-1) (BAUTX-09 rev 5); d) HTR-1 to EV-1 piping segment; (PID BAUTX-09 rev5 to PID BAUTX-013 rev3) e) HPL to HTR-1 piping segment; (PID BAUTX-07 rev4 to PID BAUTX-09, rev5), f) HTR-1 to PH-1 piping segment; (PID BAUTX-09 rev5, to PID BAUTX-14, rev4 ).
