29 CFR 1926.451(c)(2)(v):The employer used forklifts to support scaffold platforms without ensuring that the entire platform was attached to the forks: (a)Walter Ree Masonry, Inc. at 601 East 90th Street in Sioux Falls, SD 57110: On or about and at times prior to March 24, 2023, the exposing employer did not ensure that employees were protected from crushing and fall hazards in that the Haugan personnel basket was not fully secured to the forks of the JLG 610-55A telehandler. One of the locking pins was damaged and was not used to secure the personnel basket to the fork. This condition exposed employees to crushing and fall hazards. Note: Preamble to Subpart L promulgated new paragraph (c)(2)(iv) & (v) in final rule to provide guidance. Added provision requires that in the case of fork-lifts, the entire scaffold platform be secured to the forklift.

29 CFR 1926.451(g)(4)(ii): The top edge height on all suspended scaffolds guardrails were not between 36 inches (0.9 m) and 45 inches (1.2 m) above the platform surface: (a)Walter Ree Masonry, Inc. at 601 East 90th Street in Sioux Falls, SD 57110: On or about and at times prior to March 24, 2023, the exposing employer did not ensure that employees were protected from fall hazards in that the installed front guardrail of the the Haugan MWP 4x116 personnel platform, a 2x6 inch board, was positioned approximately between 25-31 inches from the floor of the platform. This condition exposed employees to fall hazards when the platform was use at heights greater than 10 feet above a lower level. Note: For supported scaffolds manufactured and placed in service before January 1, 2000, and on all suspended scaffolds where both a guardrail and a personal fall arrest system are required, the top edge height should be between 36 inches (0.9 m) and 45 inches.

29 CFR 1926.451(g)(4)(vii): Each toprail or equivalent member of a guardrail system was not capable of withstanding, without failure, a force applied in any downward or horizontal direction at any point along its top edge at least 200 pounds (890 n): (a)Walter Ree Masonry, Inc. at 601 East 90th Street in Sioux Falls, SD 57110: On or about and at times prior to March 24, 2023, the exposing employer did not ensure that employees were protected from fall hazards in that the installed front guardrail of the the Haugan MWP 4x116 personnel platform, a 2x6 inch board secured at each side with a single screw, failed when an employee leaned against the guardrail causing the employee to fall approximately 15-18 feet to the ground level. This condition exposed employees to fall hazards.

29 CFR 1926.451(h)(2)(ii): A toeboard was not erected along the edge of platforms more than 10 feet (3.1 m) above lower levels for a distance sufficient to protect employees below: (a)Walter Ree Masonry, Inc. at 601 East 90th Street in Sioux Falls, SD 57110: On or about and at times prior to March 24, 2023, the exposing employer did not ensure that employees were protected from struck-by hazards in that the Haugan MWP 4x116 personnel platform was not equipped with a toeboard to prevent tools and materials from falling when the platform was used in an elevator position greater than 10 feet above the lower level near employees working nearby on the ground. This condition exposed employees to struck-by hazards.
