29 CFR  1926.451(c)(2)(v):The employer used forklifts  to support scaffold platforms without ensuring that the entire platform was attached to the forks:  (a)Walter Ree Masonry, Inc. at 601 East 90th Street in Sioux Falls, SD 57110: On or about and at times prior to March 24, 2023, the exposing employer did not ensure that employees were protected from crushing and fall hazards in that the Haugan personnel basket was not fully secured to the forks of the  JLG 610-55A telehandler. One of the locking pins was damaged and was not used to secure the personnel basket to the fork. This condition exposed employees to crushing and fall hazards.   Note:  Preamble to Subpart L promulgated new paragraph (c)(2)(iv) & (v) in final rule to provide guidance. Added provision requires that in the case of fork-lifts, the entire scaffold platform be secured to the forklift.

This condition exposed employees to fall hazards when the platform was use at heights greater than 10 feet above a lower level.   Note:  For supported scaffolds manufactured and placed in service before January 1, 2000, and on all suspended scaffolds where both a guardrail and a personal fall arrest system are required, the top edge height should be between 36 inches (0.9 m) and 45 inches.
