29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b) a) On or about 03/24/2023, at the Dens Residential Complex, located on 2715 Manitou Road, in Rochester, New York, the employer did not enforce the use of fall protection for employees working 35 feet above lower levels. Employees were allowed to perform framing work without fall protection exposing them to fall hazards. NO ABATEMENT CRTIFICATION REQUIRED
