29 CFR  1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:   a)  Tube Cutting Area; On or about March 24, 2023, the employer exposed employees to crushed-by hazards in that employees were allowed to operate a Komatsu 80 (ECL-51) press with an unguarded material carriage, the light curtain guarding left a 3.5 inch opening that allows employees to place their hands/fingers on the rail the material carriage rides on.

29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:  a) Tube cutting area:  On or about March 24, 2023, the employer exposed his employees to potential hazardous energies in that employees were allowed to perform service and/or maintenance on the KASTOwa C7/9-R  (old automatic tube saw) without first locking it out to prevent accidental startup of the machine.  b)  Tube cutting area:  On or about March 24, 2023, the employer exposed his employees to potential hazardous energies in that employees were allowed to perform service and/or maintenance on the KASTOwa (new automatic tube saw) without first locking it out to prevent accidental startup of the machine.  Madix was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.147(c)(4)(i), which was contained in OSHA inspection number 1623363, citation number 1, item number 1 and was affirmed as a final order on December 23, 2022, with respect to a workplace located at 500 Airport Road, Terrell, TX 75160.  Madix was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.147(c)(4)(i), which was contained in OSHA inspection number 1403315, citation number 1, item number 1 and was affirmed as a final order on October 8, 2019, with respect to a workplace located at 500 Madix Drive, Eclectic, AL 36024.
