29 CFR 1926.102(a)(1): The employer did not protect each employee engaged in roofing work by requiring the employee to wear eye and face protection while operating a pneumatic nail gun. The employer does not require the use of any form of eye/face protection during roofing work. This violation was most recently observed on or about March 28, 2023, at Lot 34 Jacobs Ridge, Uniontown Ohio 44685, where five employees were not protected from struck by/flying debris hazards from employees installing roofing material with air driven/power driven nail guns. To abate this violation, the employer must ensure that its employees utilizing air driven/power driven nail guns are protected from struck by/flying debris, and that no employee is allowed to utilize air driven/power driven tools without adequate eye and or face protection.

29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): The employer does not require the use of any form of fall protection during roofing work. This violation was most recently observed on or about March 28, 2023, at Lot 34 Jacobs Ridge, Uniontown Ohio 44685, where three employees were not protected from fall hazards of 23.2 feet to the ground. To abate this violation, the employer must ensure that its employees performing roofing work are protected from falls, and that no employee is allowed onto a roof more than six feet high without adequate fall protection.
