29 CFR  1926.102(a)(1):The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying objects while using a nail gun.  The employer does not require the use of eye protection during roofing work. This violation was most recently observed on June 12, 2023,  at 15 Brewster Drive, Tallmadge, Ohio 44278, where employees were exposed to being struck by a nail in the event of a malfunction. To abate this violation, the employer must ensure that its employees performing roofing work are protected from struck by hazards, and that no employee is allowed to operate an air powered nail gun without protective safety glasses.

29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   The employer does not require the use of any form of fall protection during roofing work. This violation was most recently observed on June 12, 2023,  at15 Brewster Drive Tallmadge, Ohio 44278, where  employees were not protected from fall hazards of twenty feet to the ground. To abate this violation, the employer must ensure that its employees performing roofing work are protected from falls, and that no employee is allowed onto a roof more than 6 feet high without adequate fall protection.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   1. The employer does not require the use of a safe access and egress point during roofing work. This violation was most recently observed on June 12, 2023, at 15 Brewster Drive, Tallmadge, Ohio 44278, where  employees were not protected from fall hazards of ten feet on the ladder set from the ground to the front porch. To abate this violation, the employer must ensure that its employees performing roofing work are protected from falls by installing all ladders three feet above the landing area.   2. The employer does not require the use of a safe access and egress point during roofing work. This violation was most recently observed on June 12, 2023 at 15 Brewster Drive, Tallmadge, Ohio 44278, where  employees were not protected from fall hazards of twenty feet on the ladder set from the porch to the upper roof. To abate this violation, the employer must ensure that its employees performing roofing work are protected from falls by installing all ladders three feet above the landing area.
