29 CFR 1926.651(k)(1): The employer did not ensure that daily inspections of excavations, the adjacent areas, and protective systems were made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence:    a) The Hills at Lorson Ranch Jobsite, Colorado Springs, CO 80925: On or about March 23, 2023, and at times prior, Aspen View Homes, LLC as the controlling employer, did not ensure that subcontractor employees were protected from hazards such as but not limited to, cave-in hazards in unprotected excavations at 11445 and 11457 Rushpink Street and fall hazards in that, a competent person failed to make frequent and regular inspections of the jobsites, materials and equipment.
