29 CFR  1926.1053(b)(1):Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access.  On or about March 29, 2023, the employer did not ensure that portable ladders were extended 3 feet above the upper landing. This condition exposed employees to a fall hazard.

29 CFR  1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m), or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system.  On or about March 29, 2023, employees engaged in employees engaged in roofing operations 6 feet or more above a lower level were not protected from fall hazards. This condition exposed employees to a fall hazard.  VM Roofing and Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1926.501(b)(13), which was contained in OSHA inspection numbers 1530283 , citation number 01, item number 001 and was affirmed as a final order on 07-01-2021, with respect to a workplace located at 13663 Everingham Street, El Paso, TX 79928.  VM Roofing and Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1926.501(b)(13), which was contained in OSHA inspection numbers 1436936, citation number 01, item number 001 and was affirmed as a final order on 11-05-2019, with respect to a workplace located at 13541 Tynemounth Street, El Paso, TX 79928.
