29 CFR 1910.106(e)(2)(ii)(b)(2): The quantity of Category 2, 3 or 4 flammable liquid located outside of an inside storage room or storage cabinet in a building or in any one fire area of a building exceeded 120 gallons: a) On or about March 30, 2023, employees were exposed to potential fire and explosion hazards due to liquid heptane and liquid ethanol, Category 2 flammable liquids, being stored in a fire area of a building in quantities greater than stated in 1910.106(e)(2)(ii)(b)(2). The employer stored at least one 55-gallon drum of reclaimed heptane located near the west wall of the production area, three 55-gallon drums of heptane, located near the dock, and one 420-gallon tote of ethanol, adjacent to the winterization process. b) On or about March 30, 2023, employees were exposed to potential fire and explosion hazards due to liquid heptane and liquid ethanol being stored in a fire area of a building in quantities greater than stated in 1910.106(e)(2)(ii)(b)(2). The employer stored at least one 420-gallon tote of waste solvent, a Category 3 flammable liquid in the production area. In accordance with 29 CFR 1903.19 (d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstration that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.106(e)(6)(ii): Category 1 or 2 flammable liquids, or Category 3 flammable liquids with a flashpoint below 100 �F (37.8 �C), shall not be dispensed into containers unless the nozzle and container are electrically interconnected. Where the metallic floorplate on which the container stands while filling is electrically connected to the fill stem or where the fill stem is bonded to the container during filling operations by means of a bond wire, the provisions of this section shall be deemed to have been complied with. (a) On or about March 30, 2023, and at times prior, employees were exposed to fire and explosion hazards due to category 2 flammable liquids being dispensed from 55-gallon drums and 420 gallon totes during the extraction of canniboids (winterization) into glass beakers using a siphon drum pump, which cannot be electrically interconnected. (b) Between July 17, 2023, to July 28,2023, and at times prior, employees were exposed to fire and explosion hazards due to category 2 flammable liquids being dispensed from 55-gallon drums and 420 gallon totes during the extraction of canniboids (winterization) into glass beakers using a siphon drum pump, which cannot be electrically interconnected. In accordance with 29 CFR 1903.19 (d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstration that abatement is complete must be included with your certification. 29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met (a) On March 30, 2023, The employer did not implement, at the workplace, a written hazard communication program in accordance with 29 CFR 1910.1200 that describe at least the following: 1) Requirement for labeling of containers of hazardous chemicals: 2) Training of employees; 3) A complete list of hazardous chemicals known to be in the workplace; 4) Methods to inform employees of the hazards of non-routine tasks; and, 5) Methods to inform other employer(s) of material safety data sheets availability; the labeling system and any precautionary measures to protect employees. Employee(s) were exposed to hazardous chemicals from the extraction of canniboids operations which included but not limited to ethanol (Flashpoint 55 �F) and heptane (Flashpoint 25 �F). The 420-gallon tote containing ethanol in the production area was not labeled to identify product and the hazards of the product. b) On March 30, 2023, the employer did not ensure that each container of hazardous chemicals in the workplace was labeled with the product identifier and hazards of the chemicals contained therein. The 55-gallon drum and 420-gallon totes containing heptane, ethanol and in the production, areas were not labeled identifying the product and the hazards of the product. In accordance with 29 CFR 1903.19(d) abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition documentation demonstration that abatement is complete must be included with your certification.
