29 CFR 1910.147(d):Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence: On or about, March 28, 2023, the employer did not ensure that employees implemented energy control application steps prior to allowing them to perform service and maintenance activities on Acasi manufactured piston filler machine. As a result, employees in the production area were exposed to caught-between and amputation hazards associated with the unexpected lowering of the machines filling nozzle while performing service and maintenance activities including, but not limited to, set-up and cleaning. As a result, the remaining applicable energy control elements, involving preparation for shutdown [1910.147(d)(1)], machine or equipment shutdown [1910.147(d)(2)], machine isolation [1910.147(d)(3)], render safe all potentially hazardous stored or residual energy [1910.147(d)(5)(i)], and verification of isolation [1910.147(d)(6)] were not implemented to protect employees from machine servicing hazards, likely to result in serious injury. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. On or about, March 28, 2023, the employer did not ensure that daily examinations of their forklifts were being conducted prior to use. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).
