29 CFR  1926.502(d)(15):Anchorage points used for attachment of personal fall arrest equipment were not  independent of any anchorage point being used to support or suspend platforms and capable of supporting at least 5,000 pounds (22.2 kN) per employee.  a) On the roof of a residence, located at 3800 Gulf Blvd, Saint Petersburg, FL: On or about 04/05/2023,  the employer exposed employees to a fall hazard in that, employees engaged in residential roofing activities were using temporary anchor points that were not properly installed according to the manufacters installation instructions.

29 CFR  1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems:   a) On the roof of a residence, located at 3800 Gulf Blvd, Saint Petersburg, FL: On or about 04/05/2023, the employer exposed employees to fall hazards, in that, fall protection was not utilized by employees while performing roofing work on a residential roof that had an elevation greater than 6 ft with an estimated pitch of 5:12.  New Era AG Construction LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1926.501(b)(13), which was contained in OSHA inspection number 1608871, citation number 1, item number 1 and was affirmed as a final order on 07/27/2022, with respect to a workplace located at 400 Benton Drive, Appleton, WI 54913.

29 CFR  1926.503(b)(1):The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.  a) On the roof of a residence, located at 3800 Gulf Blvd, Saint Petersburg, FL: On or about 04/05/2023, the employer exposed employees to fall hazards, in that, the employer did not have fall protection certification of training for employees conducting roofing work.
