29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents: On April 10, 2023, Jose Lopez and an employee were installing shingles on a new residential building located at Lot 89 Pickney Ridge Estates in Warrenton, Missouri. Pneumatic nail guns were being used without eye protection. The employee was exposed to struck-by hazards.

Employees engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest systems: On April 10, 2023, Jose Lopez and an employee were installing shingles on a new residential building located at Lot 89 Pickney Ridge Estates in Warrenton, Missouri. The employer did not ensure that fall protection was worn while work was being performed on the roof approximately 12 feet above the lower level. The employees were exposed to fall hazards.
