29 CFR  1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  A written respiratory program was not developed for an employee required to wear a half face respirator while mixing pigments into paint.  An employee was exposed to respiratory hazards such as paint vapors and particulates.

29 CFR  1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace.  An employee required to use a Honeywell 7700-SOL half facepiece respirator while mixing pigments into paint was not medically cleared prior to use.  An employee was exposed to respiratory hazards including paint vapors and particulates.

29 CFR  1910.1200(e)(1)(i): The employer did not compile a list of the hazardous chemicals known to be present using a product identifier that was referenced on the appropriate safety data sheet.   A) In the warehouse:  A chemical list for paints and varnishes, to include Wood Pride Polyurethane Interior Satin Varnish, Rodda Variseal Enamel Undercoat, and PPG Paint thinner, used by employees to touch up furniture was not available.  Employees were exposed to chemical hazards.  B) In the Paint Shop: A chemical list for paints, thinners and resins stored and processed for retail sale by employees and for paints and pigments, to include Morware Exterior Traffic Marking and Striping Paint and PPG Multiprime 4160, mixed in an electric mixer by an employee was not available.  Employees were exposed to chemical hazards.
