OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to fall, crushing, and struck-by hazards due to improper use of roofing equipment. a) Momentum Builders, Inc. 8416 Sharon Mercer Rd, Mercer, PA 16137- On or about 04/13/2023 and at times prior thereto, employees were instructed to use the wrong style of clamp to secure the MR-24 Roof Seamer Platform. Employees used C-clamp style clamps when the manufacturer owner's manual and warning labels state to use locking pliers.

29 CFR 1926.502(d)(16)(iii):Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level: a) Momentum Builders, Inc. 8416 Sharon Mercer Rd, Mercer, PA 16137- On or about 04/13/2023 and at times prior thereto, employees were exposed to hazards associated with the improper use of fall protection systems. The Protecta rope grab fall protection system (Model#1340005) was not setup and rigged to prevent employees from contacting the lower level as evident by the incident that took place on 04/13/2023.
