OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: The potential hazards that could cause injury during decommissioning of machinery are widely recognized by the industry. ANSI B11.0 Chapter 5.6 ? 2023 states that ?the user shall ensure that acceptable risk is maintained during decommissioning of machinery? and that ?the means to disconnect, isolate and dissipate all sources of hazardous energy of the machine shall be identified and the hazardous energy controlled?. The employer was failing to protect employees from chemical burns and inhalation hazards. This was most recently documented on or about April 18, 2023 at 3838 South 108th Street, Omaha, Nebraska. The employer failed to ensure that employee(s) conducting decommissioning of the CO2 laser took necessary safety precautions during the cutting process. The tank contained an unknown liquid that was released into the air in the form of a mist. Possible components of this mist according to the Operating Manual are copper inhibitor, aluminum inhibitor, laser biocide and sanitizer. FEASIBLE AND ACCEPTABLE ABATEMENT METHODS TO CORRECT THIS HAZARD INCLUDE BUT ARE NOT LIMITED TO: 1) Conduct risk assessment of decommissioning that takes into account special disposal and recycling requirements for the machine and/or instructions associated with the SDS on materials in the equipment. 2) Ensure all sources of hazardous energy of the machine are drained and dissipated before decommissioning.

The employer was failing to ensure that welding stations were enclosed with screens on all sides to prevent employees transiting the welding department from being exposed to arc welding rays.
