29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form. Ohio Pickling and Processing located at 1149 Campbell Street in Toledo, Ohio. On or about April 18, 2023, the employer failed to identify and evaluate the respiratory hazards associated with exposure to muriatic acid. Employees working on or near the pickling line are required to wear respiratory protection when the lid from tank #4 is removed. Failure to identify and evaluate the respiratory hazards associated exposure to vapors emitted from muriatic acid exposed employees to acute and/or chronic respiratory system injury/illnesses.

Employers shall base the selection of the appropriate hand protection on an evaluation of the performance characteristics of the hand protection relative to the task(s) to be performed, conditions present, duration of use, and the hazards and potential hazards identified. Ohio Pickling and Processing located at 1149 Campbell Street in Toledo, Ohio. On or about April 18, 2023 the employer failed to select appropriate hand protection relative to the task(s) to be performed, conditions present, duration of use, and the potential hazards identified. Employees are exposed to chemical burns through the handling of muriatic acid as part of the steel pickling process. The employer did not follow the personal protective equipment outlined in the Safety Data Sheet for hand protection when handling muriatic acid.

On or about April 18, 2023, the employer did not ensure that portable fire extinguishers were maintained in a fully charged operable condition and kept in their designated areas at all times except during use. Several fire extinguishers throughout the CP line and slitter area were not stored within their designated area. Failure to store fire extinguishers within their designated areas exposed employees to fire hazards, in that when necessary for use, the units were unavailable.

29 CFR 1910.134(g)(1)(i)(A):Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function: Ohio Pickling and Processing located at 1149 Campbell Street in Toledo, Ohio. On or about April 18, 2023, The employer failed to ensure employees who are required to wear tight-fitting respirators as part of their personal protective equipment for exposure to Muriatic Acid tasks did not have facial hair that interferes with the seal of the respirator. An employee was observed with facial hair who was required to wear a tight fitting respirators that impeded the sealing surface of the respirator. Failure to enforce requirements set forth in 29 CFR 1910.134 exposes employees to respiratory illnesses associated with exposure to Muriatic acid.
