29 CFR  1910.132(d)(1)(i):When the employer had assessed the workplace hazard(s) and determined that hazard(s) were present, the employer did not select and/or use the types of personal protective equipment that would protect the affected employee from the associated hazards.   On or about April 20th, 2023 the employer did not select the appropriate type of PPE to protect employees from hazards associated with the use of Methyl Ethyl Ketone (MEK). The employer conducted a PPE hazard assessment for the laborers in the tray washing area located in plant 6 handling MEK when removing ink from the trays, however, did not select appropriate gloves to protect against dermal exposure to MEK such as but not limited to skin irritation, redness, rash, and burning.

29 CFR 1910.138(b):  The employer did not base the selection of the appropriate hand protection on an evaluation of the performance characteristics of the hand protection relative to the task(s) to be performed, conditions present, duration of use, and the hazards and potential hazards identified:   On or about April 20th, 2023, the employer did not provide appropriate hand protection for employees tasked with using MEK for ink removal processes in the tray washing area in plant 6, in that the efficacy of the gloves provided was compromised in that the permeability associated with MEK use is ineffective due to the nitrile composition of the gloves. This exposed employees to potential illnesses such as but not limited to skin irritation, redness, rash, and burning.
