29 CFR  1910.107(c)(5): Electrical equipment in spraying areas, where deposits of combustible residues were accumulated, were not approved for the location.   a. On or about April 21, 2023, the employer did not ensure electrical equipment containing deposits of ignitable residues was approved for locations when present in the spray area located outside of the paint booth. This spray area is used for smaller parts, and paint accumulations were found on the fan used in this area.  b. On or about April 21, 2023, the employer did not ensure electrical equipment containing deposits of ignitable residues was approved for locations when present in the spray area located outside of the paint booth. This spray area is used for smaller parts, and paint accumulations were found on the power strips used in this area.

29 CFR  1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace.  On or about April 21, 2023, the employer failed to provide a medical evaluation to employees required to wear full or half faced respirators while spray coating in the paint booth.

29 CFR  1910.134(f)(1): The employer did not ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter.  On or about April 21, 2023, the employer failed to ensure employees required to use a tight-fitting full facepiece respirators while spray coating inside the spray booth were fit tested prior to initial use of the respirator.

29 CFR  1910.134(g)(1)(i)(B): Respirators with tight-fitting facepieces were worn by employees with a condition that interfered with the face-to-facepiece seal or valve function.  On or about April 21, 2023, the employer failed to ensure employees did not have a condition that interfered with the face-to-facepiece seal for an employee that wore a sleeve on the head that went underneath the respirator.

29 CFR  1910.134(h)(2)(i): Respirators were not stored to protect them from damage, contamination, dust, sunlight, extreme temperatures, excessive moisture, and damaging chemicals or  were not packed or stored to prevent deformation of the facepiece and exhalation valve.  On or about April 21, 2023, the employer failed to ensure respirators were stored to protect them from damage, contamination, and dust from grinding equipment and flammable liquids for employees required to wear respirators while spraying in the paint booth.

A clear space of not less than 3 feet on all sides was not kept free from storage or combustible construction.   On or about April 21, 2023, the employer did not ensure spray booths had a clear space of not less than 3 feet on all sides that was kept free from storage when storing items to include, but not limited to, parts used for spray finishing, parts to be painted, flammable cabinets, workbenches, and paints.

29 CFR  1910.1200(f)(6): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the information specified under paragraphs (f)(6)(i) through (ii) of this section.  On or about April 21, 2023, the employer failed to ensure that secondary containers of chemicals to include, but not limited to, paint thinner and Gleme, were labeled with the information contained in paragraphs (f)(6)(i) through (ii) of this section. The labels that were in place did not include signal words, hazard statements, pictograms, precautionary statements or words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals.
