29 CFR  1910.134(d)(1)(i):  Selection of appropriate respirators was not based on the respiratory hazard(s) to which the worker was exposed and user factors that affect respirator performance and reliability:  Maintenance Shops: On and/or before April 19-20, 2023, employees used Watco Rustoleum Laquer, Rustoleum Multipurpose Enamel, Klean Strip Stripper, Watco Teal Oil, Gunk Battery Terminal Protector, TLR44 Plus Aerosol, and Minwax Polyacrylic Finish (non-aerosol) during maintenance tasks and wore voluntary use 3M N95 face filtering respirators.  The employer did not select and provide an appropriate respirator option based on the product's associated health hazards which potentially exposed employees to reproductive hazards, central nervous system depression, and upper respiratory inflammation.

29 CFR  1910.151(c):  Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:  Event Kitchens: On and/or before April 19-20, 2023, employees were handling corrosive chemicals such as Aqua Quat Sanitizer and Oven Cling Degreaser during cleaning operations where an emergency eye wash station in close proximity for flushing of the eyes was blocked by 5-gallon trash containers. The employer had not kept the stations free of blockage which potentially exposed employees to severe eye burns or blindness.

The Fantasy Springs Resort Casino was previously cited for a violation of this occupational safety and health standard or its equivalent standard (1910.134(d)(1)(iii)), which was contained in OSHA inspection number 1467867, citation number 1, item number 1/b and was affirmed as a final order on 06-17-2020, with respect to a workplace located at 84245 Indio Spring Parkway, Indio, CA 92203.

29 CFR  1910.132(d)(2):  The employer did not verify, through a written certification, that the required workplace hazard assessment had been performed:  Maintenance Shop: On and/or before April 19-20, 2023, employees conducted brazing and soldering operations during HVAC and plumbing maintenance operations and were required to wear personal protective equipment such as vinyl and/or nitrile gloves, safety glasses with side shields, and a voluntary use 3M N95 face filtering respirator.  The employer did not verify required workplace hazard assessments had been completed with a written certificate. The employees were potentially exposed to metal fumes inhalation hazards, dermal burns, and eye damage.

The employer had not provided the respirator user(s) with the information contained in appendix D which potentially exposed employees to Silica/Portland Cement, Hanta virus, and other inhalation hazards.
