This was most recently demonstrated on or about April 6, 2023, and at times prior to, when liquified petroleum gas containers were being stored inside the facility in areas normally traveled by employees or intended for safe exit.

29 CFR  1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible:  At a worksite located at 1248 Crystal Ave, Kansas City, MO:   The employer failed to protect employees from respiratory hazards; including but not limited to dermatitis, allergic respiratory effects, and mucosal and nonallergic respiratory effects. This was most recently demonstrated on or about April 6, 2023, and at times prior to, when employees wore an N95 respirator and had not been provided with a copy of Appendix D of the respiratory protection standard.

29 CFR  1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function: (Construction Reference 1926.103)  At a worksite located at 1248 Crystal Ave, Kansas City, MO:   Employees were exposed to health hazards in the form of toxic or hazardous substances. This was demonstrated on or about April 6, 2023, and at times prior to when employees were exposed to crystalline silica hazards when employees were directed to use a tight-fitting respirator while mixing concrete to create stone facades.

At a worksite located at 1248 Crystal Ave, Kansas City, MO:   Employees were exposed to health hazards in the form of unsanitary conditions. This was demonstrated on or about April 6, 2023, and at times prior to when employees were not provided with potable water for the purposes of drinking and washing their person. The employer failed to provide employees with potable water at their place of employment.

This was most recently demonstrated on or about April 6, 2023, and at times prior to when employees were exposed to concrete mixes containing crystalline silica and the employer had not developed or implemented a written hazard communication program. This also included no training being provided to employees regarding the use of chemicals and substances to create the facade stone.
