29 CFR  1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:  (a)Site Work Specialists, Inc. at the intersection of Box Road and North Ellsworth Road, Box Elder, SD 57719:  On or about and at times prior to April 25, 2023, the employer did not ensure that employees were removed from a hazardous area within an unprotected excavation.  Two employees were working within the unprotected excavation that was deeper than five feet and no protective system installed and in plain view of the competent person.  This condition exposed the employee to cave-in hazards associated with trench wall failure.

29 CFR  1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations, or by a combination of both if necessary:  (a)Site Work Specialists, Inc. at the intersection of Box Road and North Ellsworth Road, Box Elder, SD 57719:  On or about and at times prior to April 25, 2023, the employer did not ensure spoil piles were positioned two feet or greater from the edge of the trench excavation where employees were in the trench performing work.   This condition exposed employees to struck-by and crushing hazards.

29 CFR  1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c):  (a)Site Work Specialists, Inc. at the intersection of Box Road and North Ellsworth Road, Box Elder, SD 57719:  On or about and at times prior to April 25, 2023, the employer did not ensure that employees conducting water pipe installation within an unprotected excavation greater than five feet in depth were adequately protected from trench wall cave-in.   This condition exposed employees to struck-by and cave-in hazards associated with a trench wall collapse.  Site Work Specialist, Inc. was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection number 1412811, citation number 1, item number 1 and was affirmed as a final order on November 19, 2019, with respect to a workplace located at Disk Drive and Haines Avenue Project, Rapid City, SD 57701.
