29 CFR 1926.501(b)(4): Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes: a) Shingle and Metal Roofs LLC, on or about April 4, 2023 at the address of 819 N. Yondota Rd. Curtice, OH 43412: The controlling employer did not ensure that employees performing roofing work atop a post and frame structure were adequately protected from falling through eight fiberglass skylights measuring 3' X 8' on a low slope roof. Employees performing these work activities without the benefit of an effective form of fall protection, such as personal fall arrests systems, covers or guard railing were exposed to falls of between 14ft - 20ft onto the concrete floor below.

Such programs would support the employer and employees in identifying and avoiding potential hazards such as falls during job site operations, decreasing the probability of employee injury and/or illness. Shingle and Metal Roofs LLC was previously cited for a violation of Occupational Safety and Health Standard 1926.20(b)(1), which was contained in OSHA inspection number 1545170, citation number 1, item number 1a and was affirmed as a final order on December 9, 2021 with respect to a workplace located at 8220 Erie St. Sylvania OH, 43560.

Yondota Rd. Curtice, OH 43412: The controlling employer did not ensure employees were protected from falls while operating atop a low sloped roof. Employees removing/replacing metal sheeting roofing materials atop a barn style structure were exposed to falls between 14ft - 20ft to the ground below. Shingle and Metal Roofs LLC was previously cited for a violation of an equivalent Occupational Safety and Health Standard 1926.501(b)(13), which was contained in OSHA inspection number 1545170, citation number 1, item number 1b and was affirmed as a final order on December 9, 2021 with respect to a workplace located at 8220 Erie St. Sylvania OH, 43560.

Yondota Rd. Curtice, OH 43412: The controlling employer failed to report on employee hospitalization (admittance) following a workplace incident (fall through a roof). The employer or employer representative failed to contact the Toledo Area Office or the 24-hour OSHA number to notify the agency of the employee hospitalization within 24 hours of admittance. The injured employee was admitted on April 4, 2023, for related in-patient treatment. The employer did not report the incident or made an attempt to report the incident to the Toledo Area Office.
