29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator before the employee was fit tested or required to use the respirator in the workplace.  On or about 4/26/2023, AgXplore International, LLC., did not ensure employees received a medical evaluation before wearing a 3M half-face respirator or N95 tight-fitting respirators before the employees were fit tested or required to use the respirator in the workplace.

29 CFR 1910.134(f)(2):  The employer did not ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter.  On or about 4/26/2023, AgXplore International, LLC., did not ensure employees received an annual fit test evaluation for the use of  3M half-face respirators or N95 tight-fitting respirators.

29 CFR 1910.134(c)(1):  A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use.  On 4/26/2023, AgXplore International, LLC, had not developed or implemented a written respiratory protection program that included employee medical evaluations and fit testing.  Employees are required to wear half-face or N95 tight-fitting respirators while mixing chemicals.  Employees did not receive annual medical evaluations or fit testing.
