29 CFR  1926.21(b)(2):The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:  Site: 32-03 39th Ave. Long Island City, NY.   a) On or about April 26, 2023; The employer did not provide hazard recognition training to an employee exposed to hazards from demolition activities at a construction site.  Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR  1926.501(a)(2): The employer did not determine if the walking/working surfaces on which its employees were to work on, had the strength and structure integrity to support employees safely:  Site: 32-03 39th Ave. Long Island City, NY.   a) On or about April 26, 2023; An employee demolishing a concrete slab floor was exposed to fall crush-by/struck-by hazards when the floor collapsed.  The employer did not determine if the floor had the strength and structural integrity to support employees during demolition activities.   Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR  1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could neither free fall more than 6 feet (1.8 m), nor contact any lower level:  Site: 32-03 39th Ave. Long Island City, NY.   a) On or about April 26, 2023; An employee utilized a personal fall arrest system while engaged in demolition activities. The system was rigged in a manner that  exposed an employee to a free fall hazard of approximately 12-feet to the lower level.  Note: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

Site: 32-03 39th Ave. Long Island City, NY.   a) On or about April 26, 2023; Employees were exposed to fall hazards due to improper use and application of fall protection equipment utilized at the site. The employer did not retrain employees who lacked understanding and skills required by a fall protection training program.    Note: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
