29 CFR 1926.501(b) (13):  The employer did not ensure that each employee engaged in residential roofing activities with unprotected sides and edges (6) feet or more above lower levels, was protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system.   a) On April 27, 2023, employees engaged in residential roofing  were not protected from fall hazards while working at an elevation of approximately 40 feet above the ground.  In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.  The N.D. Construction Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1604916, citation number 1, item number 2 and was affirmed as a final order on November 14, 2022, with respect to a workplace located at 555 Lakeview Parkway Vernon Hills, Illinois 60061.
