29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    (a) On or about July 1, 2025, at a jobsite located at 5043 Yates Rd, Lot 19, Mount Pleasant, WI 53405, employees conducting roofing activities to include paper and shingle installation on a 6:12 pitch roof of the structure were not protected from falling to the lower level. This exposed employees to a fall hazard of up to approximately 14-feet 6-inches onto gravel, dirt, and building materials.  N.D. Construction Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1666520, citation number 1, item number 1 and was affirmed as a final order on October 11, 2023, with respect to a workplace located at 2035 Sequoia Ave, Mundelein, IL 60060.  N.D. Construction Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1604916, citation number 1, item number 2 and was affirmed as a final order on November 14, 2022, with respect to a workplace located at 555 Lakeview Parkway, Vernon Hills IL 60061.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access, or were not secured:  (a) On or about July 1, 2025, at a jobsite located at 5043 Yates Rd, Lot 19, Mount Pleasant, WI 53405, the portable extension ladder being used to access the upper landing area or roof of the structure did not extend at least three feet above the upper landing area and/or was not secured. This exposed employees accessing and egressing the roof, to a fall hazard of approximately  12-feet 6-inches onto gravel, building materials, and dirt.  N.D. Construction Corporation was previously cited for a violation of this occupational safety and health standard or its equivalent standard 19261053(b)(1), which was contained in OSHA inspection number 1604916, citation number 1, item number 3, and was affirmed as a final order on November 14, 2022, with respect to a workplace located at 555 Lakeview Parkway, Vernon Hills IL 60061.
