29 CFR  1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section.  1). Whirlpool Corporation, on or about April 27, 2023 at the address of 1300 Marion-Agosta Road, Marion OH 43302: The employer failed to develop, document and utilize a energy control procedure to control potentially hazardous energy for die tool 799. The employee was removing a jammed part from die tool 799, position D6, without the benefit of fully controlling all potentially hazardous energy. Due to this condition, the employee was exposed to a crush/pinch point hazard and sustained an amputation to their left middle finger.

29 CFR  1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in 29 CFR 1910.147(d)(1)-(6) and was not done in sequence as required by 29 CFR 1910.147(d).   1). Whirlpool Corporation, on or about April 27, 2023 at the address of 1300 Marion-Agosta Road, Marion OH 43302: The employer failed to ensure established procedures for the application of energy control was done in sequence to ensure the Danly 600 - Ton Tops Line West Press was fully deenergized prior to the servicing/maintenance task. The employee was removing a jammed part without the benefit of fully controlling all potentially hazardous energy. Due to this condition, the employee was exposed to a crush/pinch point hazard.

Whirlpool Corporation, on or about April 27, 2023 at the address of 1300 Marion-Agosta Road, Marion OH 43302: Employer did not effectively train employees to ensure that the purpose and function of the energy control program was understood by employees. The employer did not ensure employees understood when a task is considered minor servicing or maintenance and/or servicing.  As a result the employee performed a maintenance and/serving activity without the benefit of fully controlling all potentially hazardous energy.  Due to this condition, the employee was exposed to a crush/pinch point hazard and sustained an amputation to their left middle finger.

29 CFR  1910.217(h)(10)(ii)(A): Employer did not ensure safety checks were performed prior to operation with testing rod according to the presence sensing device manufacturer's instructions to determine that the presence sensing device used for  presence sensing device initiation is operational.   1). Whirlpool Corporation, on or about April 27, 2023 at the address of 1300 Marion-Agosta Road, Marion OH 43302: Employer did not ensure safety checks were completed for the presence sensing device(PSD) on the West Topps press each shift per manufactures instructions. Employee entered the working area protected by a PSD (light curtain) while Danly 600 - Ton Tops Line West Press was energized without performing safety check prior to operating the press to ensure it was fully operational. Due to this condition, the employee was exposed to a crush/pinch point hazard.

Whirlpool Corporation, on or about April 27, 2023 at the address of 1300 Marion-Agosta Road, Marion OH 43302: The employer failed to ensure annual bloodborne pathogens (BBP) training was provided to an employee who performed  BBP or other potentially infectious material cleaning and/or sanitation tasks. Due to this condition, the employee was not adequately trained to recognized hazards associated with bloodborne pathogen exposure, exposing them to potential bloodborne pathogen hazards.
