29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed.  Employees engaged in framing operations at 10723 Cimarron Street, Papillion, Nebraska 68046, were exposed to fall hazards in that employees were using an extension ladder for access and egress to the roof and the ladder did not extend at least 3 feet above the upper landing surface.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system.  The employer is failing to protect employees from fall hazards.  This was most recently documented on or about May 4th, 2020, at 10723 Cimarron Street, Papillion, Nebraska 68046.  Employees were observed conducting roofing operations at height greater than 6 feet without fall protection.   NDG Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1475565, citation number 1, item number 1and was affirmed as a final order on 07-14-2020, with respect to a workplace located at 4923 Woolworth Ave, Omaha, Nebraska 68106.  NDG  Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1335158, citation number 1, item number 1and was affirmed as a final order on 09-16-2018, with respect to a workplace located at 3420 Bline Ave, Bellevue, Nebraska.

29 CFR  1926.503(b)(1):The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.  The employer is failing to document fall protection training.  This was most recently documented on or about May 4th, 2023 at 10723 Cimarron Street, Papillion, Nebraska 68046.  The employer indicated that he has trained his employees on the use of fall protection but he failed to document the fall protection training as required by the standard.
