29 CFR 1926.100(a):Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets. On or about May 4, 2023, employees performing trenching/ excavation work were not protected by hard hats, exposing employees to struck-by hazards. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.651(k)(2):Where the competent person finds evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees shall be removed from the hazardous area until the necessary precautions have been taken to ensure their safety. On or about May 4, 2023, the competent person failed to remove employees from the hazards associated with trenching/ excavation work, exposing employees to struck-by and caught-in hazards. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
