29 CFR 1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). On or about April 10, 2025, Employee was not protected by a protective system. Employer did not ensure cave-in protection was utilized when employee was working inside excavation at approximately 9'7 feet in depth, therefore exposing employee to hazards associated with cave-in. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19( d). Walter Tunk dba American Trenching Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1667773, citation number 1, item number 3 and was affirmed as a final order on June 29, 2023, with respect to a workplace located at 901 W. Lake St., Addison, IL. 60101.
