29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by a guardrail system, safety net system, or personal fall arrest system, or an alternative fall protection measure that meets a provision described in paragraph (b) of this section. a) Jobsite at 102 Bacton Hill Road, Malvern, PA- on or about May 4th, 2023, the employer did not ensure that employees were protected by a guardrail system, safety net system, or personal fall arrest system, or an alternative fall protection measure. Employees were installing flashing and roofing from the first story roof without fall protection, thus exposing employees to falls of approximately 13.5 feet. ACHA Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1339255, citation number 2, item number 2 and was affirmed as a final order on October 3, 2018, with respect to a workplace located at Wexford Road, Pottstown, PA 19465.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access. a) Jobsite at 102 Bacton Hill Road, Malvern, PA- on or about May 4th, 2023, the employer did not ensure that the ladder used to access the upper landing surface of the roof was extended to at least 3 feet.� Employees used ladders that were not extended at least 3 feet to access the upper landing surface of the roof to install flashing, thereby exposing employees to fall hazards up to 13.5 feet. ACHA Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1050(b)(1), which was contained in OSHA inspection number 1339255, citation number 1, item number 1 and was affirmed as a final order on October 3, 2018, with respect to a workplace located at Wexford Road, Pottstown, PA 19465.
