29 CFR 1910.120(q)(1): The employer did not develop and implement an emergency response plan to handle anticipated emergencies prior to commencement of emergency response operations: a) On the dock, on or about May 5, 2023 - The employer did not develop and implement an emergency response plan prior to an emergency response to a trichloroethylene (TCE) release. Employees on the night shift were exposed to TCE during an emergency response to a TCE release when two drums containing 280 kilograms of TCE each where pierced by a fork of a forklift.
