29 CFR 1910.147(c)(4)(i):Procedures shall be developed, documented and utilized for the control of potentially hazardous energy when employees are engaged in the activities covered by this section. a. On or about April 30, 2023 and at times prior, the employer did not ensure that employees used the documented energy control procedures for the R81 Perini paper converting machine while employees performed servicing and maintenance covered activities such as, but not limited to, clearing paper wrap-ups, servicing the ink pump and changing the doctor blades in the print unit section of the machine, thereby exposing employees to caught-in/between hazards.

CFR 1910.147(d):Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence as required by 29 CFR 1910.147(d)(1) through (d)(6): a. On or about April 30, 2023, and at times prior, employees were exposed to machine hazards associated with moving parts, in-going nip points and pinch points during servicing of the R81 Perini paper converting machine including, but not limited to, clearing paper wrap-ups, servicing the ink pump and changing the doctor blades in the print unit section of the machine. The employer failed to implement energy control application steps as the machine was not shut down or turned off to perform the servicing work [per the 1910.147(d)(2) requirements]. As a result, the remaining applicable energy control elements, involving machine isolation [(d)(3)], LOTO device application [(d)(4)], dissipation of residual energy [(d)(5)(i)], and verification of isolation [(d)(6)], were not implemented to protect employees from machine hazards.

On or about April 30, 2023 and at times prior, the employer did not ensure that each employee performing servicing and maintenance covered activities on the R81 Perini paper converting machine such as, but not limited to, clearing paper wrap-ups, servicing the ink pump and changing the doctor blades in the print unit section of the machine, received authorized employee training on the recognition of hazardous energy sources, the type and magnitude of the energy in the workplace, and the methods and means necessary for energy isolation and control, thereby exposing employees to caught-in/between hazards.

29 CFR 1910.147(f)(1): Testing or positioning of machines, equipment or components thereof. In situations in which lockout or tagout devices must be temporarily removed from the energy isolating device and the machine or equipment energized to test or position the machine, equipment or component thereof, the following sequence of actions shall be followed: 29 CFR 1910.147(f)(1)(ii):Remove employees from the machine or equipment area in accordance with paragraph (e)(2) of this section; a. On or about April 30, 2023, the employer did not ensure that an employee clearing a paper wrap-up from the print unit section of the R81 Perini converting machine, was removed from the machine prior to jogging the rollers to position the machine to clear the paper wrap-up. As a result, the employee was seriously injured after being caught in the machine.
